How To Enter: The Viking Penguin Giveaway ("Giveaway") begins at 12:01a.m. Eastern Time ("ET") on October 3, 2008 and ends at 11:59p.m. ET on October 23, 2008 ("Giveaway Period").  To enter, please visit vikingpenguingiveaway.com or clubpenguin.com, and follow the on-screen directions to complete the online entry form by providing your first name, your age range and your parent or legal guardian's email address.  Then submit this information in accordance with the on-screen instructions during the Giveaway Period.  Important: In the online entry form you must provide your parent's or legal guardian's email address so that Sponsor or Sponsor's agent can send an email to your parent/legal guardian advising him/her of your attempt to enter this Giveaway and requesting his/her permission for you to enter the Giveaway (the "Parental Notification E-mail").  A parent or legal guardian of an entrant must grant his/her permission for the entrant to enter the Giveaway and must also provide to the Sponsor (in accordance with the requirements of the Parental Notification E-mail) the name, address, age, date of birth and phone number of such entrant or such other personal information with respect to such entrant as may be required to award a prize hereunder (collectively "Personal Information") in order for such entrant to be eligible to win a prize in this Giveaway.  Failure of the parent/legal guardian to grant such permission and provide such information in the manner and within the time specified in the Parental Notification Email and these official rules will result in the disqualification of such entrant.  If your parent/legal guardian does not grant you permission to enter the Giveaway in the manner specified by the Parental Notification E-mail, or if he/she fails to provide all of the information requested in accordance with the provisions of the Parental Notification E-mail, then your entry will be disqualified.  Limit of one (1) entry per person and per parental/guardian email address.  Neither JAKKS Pacific, Inc.  ("Sponsor"), nor RPMC, Inc. Eligibility: To enter the Giveaway you must be 6 – 14 years old, inclusive, at the time of entry.  Giveaway is void in Puerto Rico and where restricted or prohibited by law. Employees, officers and directors of Sponsor, Giveaway Administrator, The Walt Disney Company and their respective affiliated companies, parents and subsidiaries, and the advertising and promotion agencies of each (collectively, "Giveaway Entities"), and their immediate families (defined as spouse, mother, father, sisters, brothers, sons and daughters) and members of their households (whether related or not) are ineligible to participate in this Giveaway.     3. Privacy: Entry in the Giveaway constitutes consent to transfer personal information to the United States for purposes of administration of the Giveaway by Sponsor and its authorized agents, and for such other purposes to which entrant or his/her parent/legal guardian may consent, or as otherwise described in these Official Rules.  All information submitted to the Sponsor as part of this Giveaway will be treated in accordance with JAKKS Pacific Inc.'s privacy policy, available at http://www.jakkspacific.com/.     4. Drawing and Notification: The Giveaway Administrator, an independent judging organization whose decisions are final and binding in all respects, will conduct a series of random draws to select one thousand (1,000) prize winners for each Weekly Period (as defined below) from amongst all eligible entries received during each applicable Weekly Period.  Non-winning entries for each Weekly Period will be carried over and included in the pool of entries for each subsequent Weekly Period.  A "Weekly Period" is defined as the period from 12:01a.m. ET Friday, October 3, 2008 until 11:59p.m. ET Thursday, October 9, 2008 and from 12:01a.m. ET of each Friday thereafter up and until 11:59p.m. ET of each following Thursday throughout the Giveaway Period.   There are a total of three (3) Weekly Periods in this Giveaway.  Drawings will be held on or about the third business day immediately following the end of each Weekly Period at or around 11:00am Pacific Time in Calabasas, CA.  Odds of winning a prize depend on the total number of eligible entries received during each Weekly Period.  Except for Canadian residents, winners will be notified by receiving the prize in the mail at the address provided by the parent/legal guardian in response to the Parental Notification Email.  For a Canadian resident to be declared a winner, he/she must also correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question to be administered by the Giveaway Administrator, by phone within the time specified by the Giveaway Administrator.  In the event that the potential winner cannot successfully complete the skill-testing question within the time specified by the Giveaway Administrator, then this will result in the disqualification of the potential winner and an alternate winner will be selected.     5. Prizes: One Thousand (1,000) Prizes for each Weekly Period, for a total of Three Thousand (3,000) Prizes:  A Viking Penguin plush toy.  (Approximate Retail Value ["ARV"] US $10.00/CAN$10.11 each).  Any difference between actual value and ARV will not be awarded.  In the event not enough entries are received in order to award all of the prizes available in a particular Entry Period, then any remaining prizes not awarded during that Entry Period will be rolled over to the next Entry Period and awarded via the drawing for that next Entry Period.  No transfers, substitutions, upgrades, credits for changes, refunds or cash equivalents for prizes are allowed except at Sponsor's sole discretion.  Sponsor reserves the right to substitute a prize of equal or greater value if a prize cannot be awarded as described for any reason and then only for a prize of equal or greater value.  Limit of one (1) prize per person, per household and per parental/guardian email address.  All prizes will be awarded.  Please allow 6 - 8 weeks for delivery of prizes.  The approximate retail value of all the prizes to be awarded is US$30,000.00/CAN$30,330.00.     6. Prize Conditions:  If an entrant or potential winner is found to be ineligible, or if he/she does not comply with the Official Rules, then such entrant or potential winner will be disqualified and, in the case of a potential winner, an alternate winner will be selected.  If a prize or prize notification is returned as undeliverable, this will result in disqualification and an alternate winner will be selected.  All federal, state, provincial, territorial, or other tax liabilities, including but not limited to sales and use taxes, goods and services taxes, excise taxes, income and withholding taxes, customs duties, fees and like amounts in connection with a winner's award, acceptance or use of a prize arising from this Giveaway are the sole responsibility of each winner.      7. Giveaway Conditions: This Giveaway is subject to all applicable federal, state and local laws of the United States only and is not subject to any laws outside of the United States.  Except where prohibited, all issues and questions concerning the construction, validity, interpretation or enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.  By participating, entrants agree to abide by and be bound by these Official Rules and the decisions of the Sponsor and Giveaway Administrator, whose decisions are final in all respects, and to waive any right to claim ambiguity in the Giveaway or these Official Rules.  By participating, entrants agree to release, discharge, indemnify and hold harmless the Giveaway Entities and each of their respective officers, directors, employees, representatives and agents from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Giveaway-related activity or participation in this Giveaway.     8. Limitations of Liability: Giveaway Entities are not responsible for lost, late, misdirected, undeliverable or incomplete online entries, email notifications or responses to the Parental Notification E-mail due to system errors or failures, or faulty transmissions or other telecommunications malfunctions and/or online entries or responses to the Parental Notification E-mail not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, or faulty transmissions, or for any problems or technical malfunctions of any telephone network or lines, cable connections or satellite transmissions, computer online systems, servers or providers, computer equipment, or entries or responses to the Parental Notification E-mail not received by Giveaway Entities on account of technical problems, or any combination thereof, including other telecommunication, cable, digital or satellite malfunctions which may limit an entrant's ability to participate.  The Giveaway Entities are also not responsible for any malfunction of the entire Giveaway website or error in the collection, processing or retention of entry information. Giveaway Entities are not responsible for computer system, phone line, cable connections, satellite links, hardware, software or program malfunctions or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Giveaway Entities are not responsible for incorrect or inaccurate entry of information caused by any of the equipment or programming associated with or utilized in the Giveaway or by any technical or human error which may occur in the processing of the entries in the Giveaway.
